LB 1038
LB 1038- Ensures Informed Consent Before Performing Genetic Testing
Introduced by Sen. Tony Fulton of Lincoln, Nebraska - District 29
Synopsis:
LB 1038 amends provisions relating to informed consent for genetic testing. Presently, a patient’s informed consent must be specifically obtained prior to the performance of any
predictive genetic test. LB 1038 would require the same informed consent prior to the performance of genetic tests ordered for diagnostic or clinical purposes. The bill also specifies that the patient be informed of the financial cost and degree of health insurance coverage for the diagnostic or predictive genetic test. LB 1038 is intended to promote greater transparency in medical care, especially when often costly genetic testing is involved, so as to prevent unforeseen financial hardships to patients and their families.
